Online Certificate in Understanding Debtor/Creditor Law and Procedure

This certificate offer a comprehensive examination of debtor/creditor law and procedure and non-bankruptcy debt management, together with an overview of the principles of bankruptcy law and procedure. Completion of this course will provide students with a thorough understanding of the creation, management and collection of debt. Through the use of three case studies, instruction will focus on the nature, creation and categories of debt; credit reports and analysis; surety and guaranty contracts and an in-depth look at mortgages and security interests. Pre-litigation efforts to collect delinquent debt will be examined, including comprehensive coverage of pertinent laws and regulations of debt collection and the consequences of abusive collection tactics. A step-by-step analysis of a collection lawsuit will be given together with a review of prejudgment and post-judgment remedies and fraudulent transfer issues. Execution and collection of final judgment, the appeal process, the role of exemptions, joint property issues, discovery issues, methods of executing on domestic and foreign judgments and an overview of bankruptcy will also be covered.
